Terms of Service

Welcome to henrii. These Terms of Service ("Terms") govern your access to and use of the henrii baby tracking application and website (collectively, the "Service"), operated by henrii ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service. By using henrii, you represent that you meet this requirement. The Service is designed for parents, guardians, and authorized caregivers to track information about children in their care.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and not share them with unauthorized individuals.
• Notify us immediately if you suspect unauthorized access to your account.
• Accept responsibility for any caregiver invitations you send, as invited users will have access to your baby's tracking data.

3. Use of the Service

henrii provides tools to help you track and organize information about your baby's daily activities, health, and development. You agree to use the Service only for its intended purpose and in compliance with applicable laws. You may not:

• Use the Service for any unlawful or unauthorized purpose.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service's infrastructure or other users' access.
• Upload malicious code, viruses, or harmful content.
• Use automated systems (bots, scrapers) to access the Service without our written permission.

4. Your Data

You retain ownership of all data you enter into henrii, including baby profiles, tracking logs, and uploaded files. By using the Service, you grant us a limited license to store, process, and display your data solely to provide and improve the Service.

You may export or delete your data at any time. Our handling of your data is further described in our Privacy Policy, which forms part of these Terms.

5. Subscriptions and Payments

henrii offers a free tier with core tracking features and paid plans (Premium and Family Forever) with additional capabilities. By subscribing to a paid plan, you agree to the following:

• Premium (Monthly/Annual): Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings.
• Family Forever (Lifetime): A one-time payment that grants permanent access to all Premium features, including future additions, for as long as the Service operates.
• Refunds: We offer a 14-day refund policy from the date of purchase. If you are unsatisfied, contact us within 14 days for a full refund.
• Price changes: We may adjust pricing for future billing periods with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect.

6. Caregiver Sharing

henrii allows you to invite other caregivers (partners, family members, nannies) to view and contribute to your baby's tracking data. You are responsible for managing these invitations and understand that invited caregivers will have access to the shared baby's data. You may revoke access at any time through your account settings.

7. Medical Disclaimer

henrii is a tracking and organizational tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Growth charts, vaccination schedules, milestone checklists, and pattern analytics are provided for informational purposes only and should not replace professional medical guidance. Always consult your pediatrician or healthcare provider for medical decisions regarding your child.

8. Intellectual Property

The Service, including its design, code, branding, logos, and content (excluding user-submitted data), is owned by henrii and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent. The henrii name, logo, and the "ii" logomark are trademarks of henrii.

9. Service Availability

We strive to keep henrii available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

10. Limitation of Liability

To the maximum extent permitted by law, henrii and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

11. Termination

You may delete your account at any time. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account if you violate these Terms, with notice where practicable.

Sections relating to intellectual property, limitation of liability, and dispute resolution survive termination.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the app at least 14 days before they take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which henrii operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
